The Structure of the Government of Southern Sudan

The Government of Southern Sudan (GoSS) was established in 2005. It exercises authority in respect to the people and the states in Southern Sudan. The powers of the Government of Southern Sudan originate from the will of the people of Southern Sudan, the Comprehensive Peace Agreement (CPA), the Interim Constitution of Southern Sudan and the Interim National Constitution.

The Constitution

The Government of Southern Sudan is based on the Interim Constitution of Southern Sudan and the principles embodied in the Comprehensive Peace Agreement.
The details of the structure of the Government of Southern Sudan and its responsibilities are defined by the interim constitution.


The Executive

The executive branch of the Government of Southern Sudan is made up of:
The President, Vice-President and the Council of Ministers.
President

The President of the Government of Southern Sudan is the head of Southern Sudan Government and the Commander-in-Chief of the Sudan People’s Liberation Army. The President of GOSS also serves as First Vice President of the Republic of the Sudan.
Vice-President
H.E Lt. Gen. Dr. Riek Machar Teny
The Vice-President (V-P) of the Government of Southern Sudan serves as the assistant to the GoSS president and is appointed by the President of the Government of Southern Sudan.
The current V-P is also the Minister for Housing, Land and Public Utilities.
Southern Sudan Council of Ministers:
The President and Vice President of the Government of Southern Sudan are also members of the council of ministers.

The Legislative

The Transitional Southern Sudan Legislative Assembly was constituted to adopt the Interim Constitution ofSouthern Sudan. After the elections in 2008, it shall be reconstituted into the Southern Sudan Legislative Assembly.
The Transitional Southern Sudan Legislative Assembly is composed of 170 members appointed by the President of the GOSS;
70% representing the Sudan People’s Liberation Movement (SPLA);
15% representing the National Congress Party (NCP); and
15% representing the other Southern Sudan political forces
The Southern Sudan Legislative Assembly shall make laws based on the following:
(a) The Interim National Constitution;
(b) The Interim Constitution of Southern Sudan;
(c) Customs and traditions of the people of Southern Sudan;
(d) Popular consensus of the people of Southern Sudan; and
(e) Any other source as it may determine.

The Judicial Branch

The Judiciary of Southern Sudan (JOSS) is responsible for explaining the laws, applying the laws, settling cases and deciding who is guilty of breaking the law in Southern Sudan.
The structure of JOSS is as follows:
(I) The Supreme Court of Southern Sudan
(II) The Courts of Appeal
(III) The High Courts
(IV) The County Courts
According to the constitution, other courts or tribunals may be established in as deemed necessary in accordance with the law.
